To me the problem is that the kids get to choose. You do the crime, you do the time. There should be no choice. A lot of kids would rather get paddled a couple of times than give up a Saturday in detention. In a few minutes the pain is gone and all is back to normal.
There should be no choice. There should be a set punishment and if you choose to do something that gets you in trouble, you have to serve out that punishment.
