She was trashed. He said he did not want her to drive when she wanted to leave his house because she was trashed. Offered to call her a cab or a friend to take her home. Now call me crazy, but if he had tried to choke/strangle her he'd have left a mark or two. This sounds like she got drunk and over reacted to me.

Please cite any credible media source which states that the Police saw no visible marks on Tila. All that I've seen so far is a press release by Merriman and his lawyer, and blog/pro-Merriman conjecture.
Remember that when Merriman was suspended by the NFL for breaking rules for steroid substance abuse a few years ago, that he and his lawyer claimed he innocently consumed it via legal dietary supplements, although no "dietary supplement" companies were subsequently indicted for selling an illegal supplement, and the NFL also did not buy his story either.
The Shawne Merriman vs Tila Tequila case may turn into a "He Said - She Said" case, however a simple statement by him, his buds partying at his house in the early hours of the morning, and his lawyer, do not exonerate him by any means.
If there was plenty of alcohol at the scene, then why would Tila need to go anywhere else to try and get alcohol, particularly at an hour when alcohol sales are prohibited?
