The Congress gave that power to President Bush/the Presidency/the Commander in Chief when they overwhelmingly voted to allow the President to prosecute the "war on terror" as he/she sees fit. That power has never been withdrawn from the Presidency.
If you do not like the President having that power...how many times have you notified your Congressman that you want that power revoked or have notified the President that you do not like drones being used in Pakistan.
You can "believe that the government has been overstepping it's power"...that is your right to do so...but it is the third coequal branch of Government...not you...that has the power to decide if "Government is overstepping it's power"...and that is the Supreme Court.
