For sure I don't think they are going to give her the death penalty even if they do get her on murder 1. There's just not enough evidence to show what exactly she did to the kid, but I think there is enough to show that however the child's life ended it wasn't an accident. Really for the premeditated I think it will come down to if they can prove the use of chloroform. Just my guess.

The theory for that is she duct taped her daughter after her death to try and make it look like she was abducted and killed by someone else, after which she planned on dumping the body somewhere. I can't recall where they found the body. I know, I know, farfetched, but possible. The whole "Nanny Zanny" thing is what prompted that, she called the Xanax "Nanny Zanny" because she gave her daughter Xanax to make her pass out so she could go out clubbing, and giving a little kid Xanax like that it would be easy to accidentally overdose her. Who knows either way, but it was an interesting theory...
