One of the two Morris County men allegedly involved in an attempted home invasion robbery earlier this week should have his first court appearance next week.
The other will have to get out of a Topeka hospital before he goes to court.
Rodney Yowell, 30, of Dunlap, is slated for his first appearance in Lyon County District Court at 12:45 p.m. Monday for allegedly breaking into 1790 Road "X" about three miles north of Neosho Rapids early Wednesday.
A court date is pending for his cousin, 35-year-old Gary Yowell of Council Grove, who was shot by homeowner Ronald Sleisher in the incident. The injuries are not believed to be life threatening.
Lyon County Attorney Marc Goodman will not press charges against Sleisher. He says homeowners can use the force they believe is necessary to defend themselves and "terminate unlawful entry" into their homes. Upon a review, Goodman told KVOE News Sleisher's actions were justified.
The Yowells both face single counts of aggravated burglary, criminal damage and possession of marijuana."
