This is the difference between a businessman and hobbyist IMHO. I am not faulting people for choosing to run their business how they see fit as the choice does not impact me either way. You obviously need to follow can-spam and if they opt-out, you remove them. I am just saying, look at any other major chain and how they do their email with members and customers. If you're not engaging them, then it's money you're leaving on the table.
