To the best of my knowledge the resignation is reported as pending the announcement of the Grand Jury.
If they indict: He will withdraw the resignation and fight.
If they do not indict: He will voluntarily resign to help ease tensions.
Makes sense. The guys cop career is over any how. Regardless if he's right or wrong.
EDIT: Having a bit of background here. I will guarantee this guy retires with a full pension from the police force if he is not indicted. If he is, and he fights, and wins. We will receive compensatory damages from the city/state in the millions.
That is certain. The only way he loses is if he's indicted and he is proven guilty of something that brings jail time. Even so, I am going to go out on a limb and say he'll never see the inside of a jail cell.
Ferguson loses in EVERY situation except him going to jail. The odds on that are very low, even if indicted.
