The reason why they haven't sent a DMCA is because they would rather have the OP do the work and build up the site, get good search engine rankings, buy/trade traffic, monetize it, and when the domain becomes semi useful, BOOM they will take it from him.
See the case below. They let xvideos steal from them for years but they did nothing. But now all of a sudden, they launch an infringement lawsuit against xvideos. Why not earlier? Because now the time is right. If I am a betting man, it's because Mindgeek wants to weaken xvideos parent company financially with this lawsuit so they can acquire Xvideos down the road. It's all about timing and letting others do your work for you.
