A comment like "this pic is free and you can do whatever you want with it, no licence attached" imply the uploaders intentions at the time given, but nobody knows if the uploader is the person they say they are... so that gives zero value

Every work produced is automatically protected by copyright ( yes, even porn). You as an author/ creator, and if you wish, you can attach Creative Common license to such work. It is designated by "cc" symbol. If the author does NOT specifically add cc license, then anybody using this work for any reason is in breach of copyright. Also, created work does NOT require to display copyright symbol "c" to be protected. The protection is automatic.
DMCA was NOT created to protect thieves, it was created to go after thieves ( or their affiliates... pun intended) once caught.
