The system is being abused and webmasters have been cheated and robbed. The clause in the terms is nothing but a guideline and recipe for broadcasters to steal from webmasters, some sort of "how to" disguised as a pseudo rule.
It's like telling children: "don't open that door, the sweets are behind it", what did they think would happen.
This kinda stuff needs to be enforced technically.
Chaturbate needs to bind affiliates at the user level instead of the username. And they need to remove those offensive banners that have nothing to do with affiliate marketing.
Even then I feel it is too late.
