Technically, he wouldn't be an attempted mass murderer either, because he had not
attempted anything yet. I can write that I would support a mass extinction of pedophiles - but I have ultimately no power to do so. I can plan it all I want but if I don't get to power I can't execute it.
You can argue the books may have been written by a psychopath or future something, but It's not accurate to say that it was written by a mass murderer.
And again playing devil's advocate like I said - if J. K. Rowling suddenly went on a shooting spree, the Harry Potter books would have to be considered to be written by a mass murderer by this logic - and who's to say she won't snap at some point and hasn't written some secret unpublished manifesto.
