The scenario you describe is what we all believe to be legit and it makes sense. It's probably enough to file a counter however we have no real life example to back this up. In short : how do you know their TOS will make you win in court if your counter is disputed?
I believe it is a little more complicated than that and that's why I am in favor of having cam sponsors handling this aspect of the business: they are the copyright owners of the tools, they give us license to use them, they wrote the TOS, they have a legal department and they know what is allowed content vs not allowed, they can get in touch and communicate with models & studios as well as affiliates. For example, AWEmpire have a process for these erroneous/abusive notices.
Given the following workflow, why is it up to webmasters to deal with that:
Cam sponsor promo tools => Webmasters => DMCA notices
-> notices are a direct consequences of doing our job
Webmasters should be focusing on PHP and traffic.
