unsolicited spam is not only illegal, its ineffective. opt-in is the key
some adult newsletters i've been receiving and reading 20 years. others go direct to spam. people open what they are interested in. a dude obsessed with feet will open every email that says 'new foot videos'. its not any different in mainstream.
i think we know which programs buy lists and spam.
