Tube Sites Seized in Copyright Infringement Case

Three of the largest gay adult studios in the U.S. have received a preliminary injunction freezing the assets of a U.K.-based tube site operator pending the outcome of a copyright-infringement lawsuit.

A spokesman for the combined forces of Corbin Fisher, Titan Media and Channel One Releasing indicated the California District Court?s decision to prevent GLBT Ltd. from transferring, selling or hiding assets is a good sign the studios will come out on top of the longstanding $29-million battle.

Corbin Fisher General Counsel Marc Randazza said the case took a turn in early August when the studios asked the court to sanction GLBT Ltd. after discovering the defendant had destroyed evidence relevant to the case. GLBT compounded that error with another, Randazza said.

?We caught them taking actions to move assets out of the United States,? he revealed, adding that although GLBT is a U.K. company, the presence of assets in the U.S. makes the company subject to U.S. law. ?They clearly know they are losing the case.

?Preliminary injunctions are difficult to win,? Randazza added. ?In laymen?s terms, [the court?s decision] basically states that one party, in this case the [gay adult studios], has shown such a strong case that the other party would all but lose if the case went to trial.?

Among other directives, the injunction orders GLBT Ltd.?s domains ? including the tube sites GayForIt.com, ItsAllGay.com and JerkYourTube.com and their dot-eu counterparts ? seized and held in receivership pending resolution of the lawsuit.

Defendants also are enjoined from redirecting any traffic; registering domains incorporating any forms of ?GayForIt,? ?ItsAllGay? and ?JerkYourTube? in other domain spaces; and taking any other action that in any way might ?cause damage or harm to the assets? or ?in furtherance of dissipation of the assets.?

?Once again, [the progress of this lawsuit] shows the power of content providers banding together to exterminate the piracy that ultimately harms not only the industry itself, but the people employed in the industry, from performers to programmers,? Randazza said.

The straight side of the business could really learn from the gay side when it comes to taking on copyright infringement/piracy (unfortunately, as is being revealed, some of the largest straight companies are also among the worst offenders when it comes to supporting piracy, but the wheels of justice are slowly catching up with them)...

The really bad thing about these sites is they limited the amount of videos users could watch and offered unlimited viewing to those uploading content. The initial idea may have been kosher; amateurs uploading their own videos for the right to watch other amateurs, but users seem to have found it easier to upload studio content to get the unlimited viewing rather than to produce their own clips of themselves.

it has nothing to do with politically correct judges and everything to do with what porno jew posted below - the straight companies are more interested in getting their share of the pie from stolen content than stomping it out. when you see a straight porn company reaching a "settlement" in legal action with a tube site it means much more than just a cash settlement.

I had hopes when Pink Visual/Top Bucks went after Manwin...but from what you are saying there was something "much more than just a cash settlement" involved???

I'm not sure that is true. Though obviously none of us really know except Fabian and Pink Visual. My feeling was that PV wasn't gonna win the case but it was gonna take both sides a lot of money to continue it so they settled on advice of lawyers.

And that's pretty much what every attorney has told me over the years. That it would basically cost me all of my money to even try to go after a big tube site and in the end the courts wouldn't do me any favors because they want us to go out of business...the tubes and torrents are just doing what the govt. couldn't legally do.

That's kinda why I'm thinking that when gay companies go after them...it adds another dimension to the mix. Sort of a "reverse discrimination" effect in a weird way.

But everything I just typed is purely conjecture based on what I see happen with these lawsuits and what I was told by attorneys for the last 3 years. Maybe things are changing now and it might actually work for one of the big companies like Hustler to go after them. Because I'm thinking that Larry Flynt's attorneys are better than any that I can afford...and for some reason they have apparently been telling him not to try a lawsuit the last 3 years too I guess.
