Arizona convicts just on the conspiracy to commit and which carries more time than the actual act itself.

Adult Talent Agents will be prosecuted as well. meaning Arizona will go after Derek of LADirect direct if he sends a model to Arizona for a sexual performance for money.

As case law: Max Hardcore sat in his California home while FLA decided to convict him for the violations in FLA.

If he's going to actually get any convictions, he's got to convince the Arizona judges to turn around and change their reasoning.

In the Taylor case from 1990, they had no problems with the California cases that hold that the activity essential to making explicit videos is not prostitution. Taylor was a peep show dancer and the court said that her conduct was miles away from what the California Supreme Court protected in Freeman.

It's the best indication we have of how Arizona judges would rule. I think this prosecutor has an uphill battle whether he knows it or not.

They might not be able to win a conviction, but they sure can make life hell. Constant raids, computer and content seizures, etc.

Just think about what he risks politically if, after all that inflammatory language, he loses the case on First Amendment grounds - and how he'll be labeled as the prosecutor who hung up the Welcome Sign for porn by taking an unnecessary case to court.

If he has any common sense, he won't direct any arrests or take any such case to court unless he's got something else in the case that's a slam dunk, guns, drugs, underage, off camera criminal misbehavior, or the like. It would not surprise me if he's on the prowl for something like that now. I think he wants to scare the porn industry away, endear himself to the moral right, but take as few chances as possible in an election year. It's always possible that someone's recklessness might hand him those things on a silver platter.

"Under Arizona law, anyone paid to appear in a pornographic movie may be guilty of the crime of prostitution, which carries mandatory jail time as well as the possibility of other penalties," Montgomery said.

Arizona law defines prostitution as "engaging in or agreeing or offering to engage in sexual conduct under a fee arrangement with any person for money or any other valuable consideration," according to the report.

Montgomery made it clear the welcome mat is not out for porn in the Grand Canyon State.

The lawyer said in an official statement, "Furthermore, anyone involved in other aspects of producing pornographic movies, including soliciting individuals to appear, collecting a fee from the monies received by individuals solicited to appear by virtue of an agent relationship, transporting individuals from California to Arizona for the purpose of appearing in a pornographic movie, and/or establishing a venue for the filming and/or production of pornographic movies may be guilty of committing one or several felonies in the state of Arizona."
