Is it illegal to use other website names in my domain name?

If I were to create a website along the lines of redditwhores.com or bestofpornhub.com
will domains like these which use other website names create legal headaches in the future?

Illegal??? Not really but you still might get sued. A lot is going to depend on who's domain you use.
For example, try using FaceBook in any possible way and watch how fast their lawyers will descend
on you.

On the other hand I'm fairly certain that JoeIdiot.com won't give a damn and will leave you alone.

Anticybersquatting Consumer Protection Act

The below list of factors that a court will consider to determine whether the domain name was registered in bad faith.

- Does the domain name holder have trademark rights in the domain name?

- Is the domain name the legal name of the domain name holder, or some other name that is otherwise commonly used to identify that person?

- Has the domain name holder made use (prior to the dispute) of the domain name in connection with a bona fide sale of goods or services?

- Is the domain name holder using the mark in a bona fide noncommercial or fair use way at a web site accessible at the domain name?

- Is the domain name holder attempting to divert consumers from the trademark owner's web site in a confusing way, either for commercial gain or in an attempt to tarnish or disparage the trademark mark?

- Has the domain name holder offered to sell the domain name to the trademark owner (or anyone else) for financial gain without having any intent to use the mark with the sale of goods or services?

- Has the domain name holder behaved in a pattern of registering and selling domain names without intending to use them in connection with the sale of goods or services?

- Did the domain name holder provide false information when applying for the registration of the domain name (or do so in connection with other domain names)?

- Has the domain name holder registered domain names of other parties trademarks?

- How distinctive and famous is the trademark owner's trademark?

it's not really about legality -- it's about who has more money / better lawyers -- and do they care or not

reddit will definitely cease-and-desist you (and seize your domain)

pornhub? much less likely

randompornsite.com ? you're fine.

I had a large mainstream dating site cease-and-desist me (and take the domain) for using a name similar to theirs.

And, webmasters rip my domain names sometimes -- I don't mind at all, its flattering and probably good for my SEO.

That's how I feel, and this is coming from someone who had to change their name/brand due to Disney exerting some extremely flimsy trademark claims. Could I have won in court? Maybe - but only after spending six figures+ for a SHOT to win. No thanks. Thus now I am Mr. The Porn Nerd. LOL

You cannot monetize it. There is a limited fair use argument to use someone's TM in your domain name.

For example... www.PepsiSucks.com - if you are complaining about Pepsi Cola products.

As soon as you try to monetize the domain - in anyway - you will loose it.

The other day I auto generated a list of LLcams.com and found one that was unregistered, but that LL in the domain name is a well known company trademark.
If I bought it and made it clear that the LL in the name means something else and I don't make the logo or anything else similar, will I be ok?

I'm pretty sure the answer is a shorter version of what most already said: depends.

I wouldn't take a chance on the potential offending domain being in a different market myself. I'd only think about how assiduously the trademark owner defends it. But who knows?

If you're going to use the domain for a cam site and the company isn't in the cam or adult business then yes. A company called Apple doesn't own the word "apple" (hence all the legal action between the computer company and the record company), and it's even less possible to own combinations of letters, especially two letters, except in the field where the name is established.

I picked up LGcams.com and am mostly just worried that LG can do something because their phones have cams on them lol. ..But LG apparently is going to stop making phones, so.. :p
So far I just put up a WL until I get around to making an API cam site with it, but I already got about 60 uniques to it according to CB stats (I didn't put GA on it yet, too lazy lol) So someone knows about it, or just some bots, not sure yet. Archive.org says nothing good has been on it for 10 years, so I don't think it's old links lol

Ah, I thought it was going to be HPcams. I think you'd only have an issue with a site about cameras or something else tenuously related to LG, and not just a Live Girls webcam site.

There's only one "cams.com" domain, so there's a justification for using variants with extra letters, and it wouldn't pass the "moron in a hurry" test; nobody is going to confuse an adult webcam site with an electronics company.

I was sued by the Speedo Corporation (who owns that these days) for using speedo on my gay sites.

It was in civil court here in Australia and I couldn't afford to defend it. Lost the domain but took them two years and the free mainstream press I got was mind blowing. From memory had 10x joins when it hit the front page of the business section of the papers.

My business has always been structured to protect my privacy and assets so I didn't mind, if my name was on it not sure I'd want that kind of press though.

Fb took a domain right from my account. No email, domain lock, nothing. Blackpeoplemeet was pretty huge at this time and I wanted blackpeopleskeet but the fb thing freaked me out. I think comedy central owns that name now.

It's unusual that they didn't go through normal UDRP proceedings, but it sounds like they went directly to your registrar's legal department with a claim of TM infringement.

I registered quarterbackclub.com back in 1998 & was going to do some fantasy football on it but never did.

Some lawyer sent me nasty letters telling me they held the trademark for it & said they were going to sue me for the domain ownership.

Never heard from them (or anyone else for that matter) again & I still own the domain.


I did own montgomerywards.com and they to sent me a nasty letter and the lawyer took a tone with me I didn't like so I sent him an email telling him to swallow my cock and pointed the domain to sears.com

The next day he changed his tone & he offered to buy it from me for some nice cash

Not worth it to use somebody else's name.

You can do something like UPSCams.xxx
And UPS the shipping company cannot say shit about it, though they will.
So long as you don't skin the site to look like their brown theme, use anything near their logo, etc.

But using pornhub? They will come at you quickly and they will get the domain so you will have wasted your time.
