Tax Information for Parents of Kidnapped Children

This is fucked up on so many levels:

Topic 357 - Tax Information for Parents of Kidnapped Children

You may claim a kidnapped child as your dependent if the following requirements are met:

1. The child must be presumed by law enforcement to have been kidnapped by someone who is not a member of your family or a member of the child's family, and
2. The child had, for the taxable year in which the kidnapping occurred, the same principal place of abode as the taxpayer for more than one-half of the portion of such year before the date of kidnapping.

If both of these requirements are met, the child may meet the requirements for purposes of determining:

* The dependency exemption
* The child tax credit, and
* Head of household or qualifying widow(er) with dependent child filing status.

This tax treatment will cease to apply as of your first tax year beginning after the calendar year in which either there is a determination that the child is dead or the child would have reached age 18, whichever occurs first.

For more information, refer to Publication 501, Exemptions, Standard Deduction, and Filing Information.

Of course but you still have to do it. hell even the dead are required to fill out taxes for the part of the year they were alive.

To clarify my statement. I didn't mean that they wouldn't pay their taxes, just that if your child is kidnapped the last thing on your mind would probably be can I still get this deduction or that deduction even though my kid was kidnapped.

the last thing on peopls mind when someone is dying in hospital is the bill, but you STILL GOTTA PAY IT. ;)

reminds me of the family that was pissed after being asked to pay rent in apartment after a parent was murdered, hello, rent aint free just because of tragedy.

my grandmother died and her bills kept piling and family had to pay it, the way the world works.

because the "estate of" is responsible for them, and when the person who dies owns property you cant just do that? As in my case, my mother was Executor, and then becomes responsible for the mess dying person leaves. Mortgage, hospital bills, inheritances, division of property, lawyer to deal with will, many costs... these things dont just disappear upon death.

if you havent been through it, its much more than just that.... you cant just let everything go unpaid because someone dies

Why is that "fucked up"?

What they basically do is ensure that if your child gets kidnapped, you don't suddenly lose tax benefits. This avoids the possibility of a tax mess if your kid gets kidnapped.

Would you prefer it if they didn't put this into code, so people would also get fucked over financially if their kid got kidnapped?

I am very well aware of that. I had to deal with that for at least 2 years after my mother passed away.

What especially sucked was places that required us to send in over and over her death certificate.
