They are in trouble because they didn't remove it for 5 weeks NOT because of hosting it. They were asked to remove it and they didn't. They are not above the law.

I think the greater issue here is if a tube site is liable for the videos its users upload. Google seems to think they arent in any way liable for the videos its users upload. Italy seems to think otherwise. I would like to know why the video was not removed when a request was made to remove it.

If you ran a tube site and someone uploaded a copyright google video to it , you can bet it wouldnt last 5 weeks

Where are you getting that? This is a quote from the referenced BBC report:

"The video at the centre of the case was posted on Google Video in 2006 shortly before the firm acquired YouTube.
