Pink Visual, how will your Content Protection Retreat go now that you folded to Mansef?

You just set a fine example by buckling to Mansef in your piracy suit. Why would anyone want to come to your Content Protection Retreat now?

If anything, true anti-piracy companies should come just to throw tomatoes at you.

What is specifically innacurate? Settling lawsuits and dropping complaints is like pregnancy... you can't be "kind of settled".

Seems like maybe they got scared by the counter-suit and decided to settle?

All the keyboard lawyers here have obviously never been in a court of law other than a traffic court. Going to trial is risky for both parties. A settlement is almost always the best outcome for any lawsuit.

Talking from experience. If you dont have the money to throw away avoid court. Even if you win on principle you lose a lot of money doing it.

Good posts.

Think positively, if a good case is built and Mansef will settle this could be a cash cow. It needs the Titans of the industry to sit up and take notice. AND affiliates to step up and back companies who are pro active in the fight against pirates.

It's cost Mansef money to fight and money to settle and left them open to others.

Posts on GFY are not going to bring down many pirates, action will.

No shit Sherlock.

However, they did take them to court and they knew the risks going in.

What was the settlement? Was it money because Mansef was in the wrong and they knew it, or was it so Mansef would drop the counter suit? This could potentially be a game changer but they are not talking about it or correcting a report they claim is inaccurate.

Furthermore, the very company holding a Content Protection Retreat who gave the illusion of getting tough on piracy, now won't even release a statement about any of this?

A settlement was the main objective from the start anyway. Their only objective. Why people here thought this would really go through a full blown trial to a verdict is beyond me.

I didn't read the latest, but if they settled, that means mansef is (was) open for business, meaning everyone else in similar situation could go "tax" them for settlements via the bluff of a lawsuit.

You guys are missing the point.

Mansef was also suing THEM. So what was the settlement?

Was it to drop the counter suit, or was it for an actual monetary settlement? If it is the latter, than I think they should let us all know so we can line up and go after them as well.

How are they going to host an anti Piracy meeting if they didn't kick Mansef's balls in?

Did a search and found this which found this at avn, which contains a link to the actual Order of Discontinuance, thanks AVN.

From the OoD:
Quote:
The parties having notified the Court that they have reached a resolution of this action, IT IS HEREBY ORDERED that the above captioned action be, and the same hereby is, discontinued with prejudice but without costs; provided, however, that within thirty (30) days of the date of this Order, counsel for either side may apply by letter for restoration of the action to the calendar of the undersigned if the settlement is not effected, in which event the action will be restored.

A conference is schedu1ed for October 7,2010, at 5:00 p.m. Any party seeking to raise an issue at this conference, shall (1) apply for restoration of the action no later than October 4,2010, and (2) in such letter, specific the issues to be addressed.
First thing to note is how short and undefined this is. This is basically a letter telling both parties that if they want to continue with whatever this action relates to, like a complaint for example or something the court asked for (see definition below) they need to file for restoration. Because they both agreed on something or didn't fulfill the requirements on something, this action is being discontinued to proceed on with something else. If they don't agree with that, they can file for restoration as long as the 'settlement, ie: whatever the terms are agreed on so far' are not modified in direct relation to this action.

The other thing to note is what an actual "Order of Discontinuance" is. It does not mean discontinue a court case. It means the stopping of legal action prior to trial, either voluntarily by the plaintiff or by order of the court. Source.

Other thing to note.. Trial is scheduled for March 2011 as per Allison.
