I work for an ISP, and help manage the network abuse department.

Things I've learned over the years:

1) Local police departments expect our technicians to explain to them the process of filing a summons.

2) Interpol's intelligence is highly exaggerated, as I've seen their techs be fooled by as little as a URL frame forwarding service.

3) Most FBI agents don't understand the concept of a proxy service

4) Nobody understands that colocation & reselling are different.

We don't care how many times a customer gets a DMCA complaint. As long as they respond to every complaint within 48 hours, and none of them are repeat complaints, the customer will stay on our network.

We have one customer who runs an image hosting service. They've received over a thousand image complaints, many of which have been sent by one dmca agent. They're a registered service provider, and everything they do is legal.

We look into all of the complaints, and do perform checks to verify that various issues have been resolved.

So what happens if some dousche does NOT comply with the DMCA? And he gets "multiple" complaints from the same party? And what if these DMCAs are not "legit", just someone fucking with another person?

You see, what disturbs me about this magical "DMCA" cure-all is what if someone says 'fuck you I ain't taking the shit down'? Then what? Then the ISP/host gets subpoenaed for the clients information.

Then the client is sued and the host might even be sued too.

And don't tell me "you can't sue the host".
You can sue anyone you god damn please, and it will cost that person the money in lawyers fees just to drop the suit if it can be proven they are really not party to the infringement or continue to have to fight on.

So best defense for the host, is to not get sued at all, because if they do, no matter which way it goes, its going to cost lots of money.

Thanks for the info. Even though I had a slight idea that not everyone knows about computers and internet as webmasters do, but having this info verified, by someone who had experienced this personally, is nice.
