Write back to them with the proof you have the rights for the DMCA content you are showing and tell them that any future wrong DMCAs will be put into the hands of your solicitors.

Write back to them and be sure to keep the correspondence. That is in case they named you in a class action lawsuit.

Contact the sponsor in question and removeyourcontent at the same time. Let them sort you out appropriately. Use a counter-DMCA notice. You can find them on the web.

If it is a dmca for sponsor content make sure you ask them to retract the notice from Google. Act fast.

Yes. Sometimes DMCA workers make mistakes. Most tubes/hosts have contacts at the various DMCA companies. Just call or email and introduce yourself in a chill non adversarial way and make a contact. Then deal directly with that person anytime there's a mess up again.

I received some bogus DMCA's too from another company. The thing is that I wasn't even hosting any content in question the notices were talking about. I guess they are mass-sending notices to all the emails they got. Stupid.

Stupid ? Not always. Our Business Affairs on occassion sends DMCA to various sites that do NOT host our content ( like review sites or various directories), BUT they point our content to pirate sites, in such they participate in teft. The conclusion usually is that the link to the content gets redeirected to us, or the listing is removed. No hassles.

they have tons of clients, and automatized the search and reporting for pirated stuff.
Piracy is STILL a much larger issue than the hassle with bogus dmcas

I got no idea. My site in question is still small now, around 2k pages and 100k uniques per month. I've received 2 bogus DMCA's so far.
One mentioned above and the other one from a sponsor I'm not promoting nor hosting their content obviously.

Well this is not a problem at all for me. The problem would be if they submited something bogus to Google, I'm afraid it could hurt my serps...
Aggressive competition uses dirty techniques like this. Something similar happened to me a few years ago. I had nice clean legit mainstream site and someone submitted it to lists/directories of harmful & virus infected sites. My serps went down immediately to shit, the site never recovered from this and I lost 80% of my earnings.

True.

Piracy is how the big tubes stay in power

The day is coming where the crooked porn tube sites will be held accountable for what they host and they will die a fast death I can't wait! There are a couple things coming down the pike that they are not aware of because if they were they would be hosting on different servers (pornhub)

Soon enough the only servers sites with stolen content will be able to host from are Russian servers

I once got a DMCA notice from a site that I didn't even mention by name, let alone have any of their content up. Turns out, one of my file names was the same as something they named one of their files.

#facepalm

Seriously these DMCA bots are getting lazy.

No you are mistaken. You'd be surprised how many MILLIONS "big" tubes spend on licensing content to stay in business.

It's actually the smaller to mid-size tubes that steal all that shit.

Big porn tubes will never die...

Just read this article and have an idea how MindGeek works

Quote:
Eventually, Pornhub would launch a content partner program, letting third parties market their wares on the site. If you watched a clip from a specific studio, you'd be directed back to its site and encouraged to sign up for a paid-for subscription. There was only one downside: Mindgeek claims 50 percent of that cash as commission.

Mindgeek stands accused of becoming a behemoth on a diet of pirated content, but its size gave it enormous power. It held smaller studios hostage, forcing them to either engage in what Rowntree calls the DMCA "whac-a-mole" or let them take 50 percent of the sales. That hasn't worked out well for sites like Wasteland, and Rowntree believes that his income has fallen by more than 35 percent. Rowntree also accuses Pornhub of being aggressively laissez-faire with respect to pirated clips from its partner program members -- a charge Pornhub refutes.

If you visit Wasteland's free Pornhub channel, you'll see that the studio has uploaded 798 clips, which have been viewed a combined 35,469,654 times. Rowntree said that his staff, and the performers in the videos, have directly received nothing. "You get a banner underneath your movie, and if somebody clicks on it and buys, then we get the honor of paying the tube back 50 percent of the revenue." Rowntree added that the sites "do send members, but it's not significant -- it's certainly nothing like it used to be."

Not everyone agrees with Rowntree. Evil Angel's Adam Grayson called Mindgeek "the most civilized [tube site] of the bunch." He added that he doesn't think the site is "such an egregious violator of [his] intellectual property rights," and that he likes the fact that it has offices in Canada. As for the matter of piracy itself, Grayson believes that free porn and the proliferation of tube sites are just a "reality of the business." Grayson feels that the content hosted by tube sites are, essentially, advertising. "If Pornhub gets $100,000 of market value from our clips, and we only get $10,000, then I have no other way to rationalize it that the other $90,000 was marketing."
