what can i do about this or does anyone have any attorney referrals that know what to do here? any help appreciated

Go after their ISP or DNS service.

Takes time though.

PR_Glen 01-12-2011 12:04 PM

not stating that you are cc'ing your lawyer kind of takes the teeth out of them.

True. But most companies will look into it and take action anyway.

I have always prefered to take the social route but contacting them. Showing them and discussing the options. Did that not long ago with a Major hosting company here and it was resolved quick and easy. No DMCA work at all no lawyers talked about. But I think that was an exception.

Glen hit me on ICQ and lest see if its the same people I am chasing around right now for some action.

Is this Oron by any chance?

Allison 01-12-2011 01:57 PM

Do it right: Hire an Intellectual property attorney.

Spudstr 01-12-2011 02:03 PM

As others said, hire a IP attorney, and go after the host they are legally responsible to respond to them.

Gator 01-12-2011 02:22 PM

What a complete pain in the ass this must be.

LeRoy is correct. If the host doesn't do anything, go after THEIR hosting provider. You can find out who they are by doing a simple traceroute to the domain with your stolen content.

Good luck.

Splendorous_Male 01-12-2011 02:47 PM

Which host is that?

czarina 01-12-2011 02:50 PM

is it a host in Gainesville, FLA?

signupdamnit 01-12-2011 02:53 PM

Get legal representation, send the DMCA violations the right way, then sue.

harvey 01-12-2011 03:22 PM

just do it right:

Or that you already did.

Four times.

Seriously, though, good luck with getting your issue with this host resolved man.

d-null 01-12-2011 05:28 PM

What is the time frame after which a host could get involved?

If you DMCA the site owner, and he complies within a reasonable time (7 days?) then the host has nothing to do with it, doesn't it? How long do you have to wait after DMCA'ing the site owner for him to not remove things before a host should even do anything about the dmca?

Not to me they don't and I send them special DMCA notices using their specified format. Everyone else accepts the generalized format proposed by the DMCA itself.

Lamis 01-12-2011 09:03 PM

This looks pretty common nowadays.

Otherwise huge pirate bays or sharing files sites would not be possible.

There is really no way to fight against it.

Look at DUKE from duke skywalker, he had to arrange a deal with them and post a banner, instead of dmca them.

Barry-xlovecam 01-12-2011 09:30 PM

DMCA is a US Law — is the host in the US?

They comply for me when I send to support@... i think

k0nr4d 01-13-2011 12:20 AM

If the host is not inside the US, they can pretty much print your DMCA and use it as toilet paper. If they are in europe, look up EUCD
