Host stole my money - my options?

http://eliteswitch.nl

They took 400 euro for me for a server, and yet didnt deliver. Been over a month now. Paypal says they cannot help against digital goods. anyone know if I got any options?

Harmon 07-05-2012 03:03 AM

I am assuming you tried contacting them via phone and email? Do you live over there? Their physical address and a map to their location is here: http://eliteswitch.nl/contact/

Pay them a visit :winkwink:

DamianJ 07-05-2012 03:04 AM

Surely leasing a server is not "digital goods"?

marktruman 07-05-2012 03:08 AM

They have ignored all contact, but reply to others no problem

No, I live in the UK

Phoenix 07-05-2012 03:12 AM

thanks will stay away from them

there are some dirtbag hosts around for sure

CamTraffic 07-05-2012 03:49 AM

CurrentlySober 07-05-2012 06:47 AM

I'd simply do a 'naughty thing' in an envelope, and send it to them, in the post..

Web hosting is a digital good now? Interesting, I'd make sure they understood exactly what it is that happened.

Tom_PM 07-05-2012 07:12 AM

It's like saying that leasing a car is just mileage and not a physical item. Bullcrap.

Tijuana_Tom 07-05-2012 07:23 AM

Web Hosting has ALWAYS been a digital good.

Zero common sense on this forum, lol.

Why the fu you using paypal?

Damn you fools need to be professional ONCE in a while.

Tom_PM 07-05-2012 07:30 AM

Well thats weird. My server even has a name and a physical address, plus employees who maintain it. How is it only digital? I even deduct it as office equipment on my taxes.

TeaForOne 07-05-2012 07:53 AM

I got stung with a server being a digital good according to PayPal. Was only $50, so I just wept and sulked away.

Tush Media 07-05-2012 08:01 AM

That really sucks

potter 07-05-2012 08:16 AM

What is PayPal’s definition of a Digital Good?

PayPal defines digital goods as goods that are sold delivered and used online in an electronic format. This could include, but is
not limited to, e-books, music files, videos, software, digital images, manuals in electronic format, and virtual goods that may
be sold in the context of a game. Services or ticketing (travel, events) are not currently considered to be digital goods.
By their own terms web hosting should not be digital goods - should be a service.

sorry to hear, but hopefully you get your money back.

Contact them and tell them if they do not refund your money or provide you the service, you are contacting your credit card company to dispute the charge. From their end, they don't know if it came from your PayPal checking or a credit card payment.

That will usually get people to get on their feet. Make sure to give them a deadline, like EOD Monday, but make sure you give them at least 2 business days.

Most merchants think they can just pass over people and screw them around, so you have to stand up and show them your not going to be had.

Hosting is not a digital good, its a service. Whom ever you spoke to at Paypal is wrong, I've had to deal with this myself several years ago.

Tom_PM 07-05-2012 08:28 AM

Of course it's a service. I can't believe people let them get away with claiming it's digital.

Someone should set their server on fire and mail it to paypal and ask them if it looks digital to them.

I cannot dispute this transaction again as the case has been closed. Anyone know the correct email I can send too?

wehateporn 07-05-2012 08:42 AM

Start many threads complaining on relevant forums. Email them all of the links

marktruman 07-05-2012 08:53 AM

Yep already have

full story is here http://www.webhostingtalk.com/showthread.php?t=1170131

stach14 07-05-2012 09:58 AM

Sounds like a very crappy situation. I would get paypal on the phone and don't stop talking until you get someone that has a clue.

:1orglaugh You really think a web host does not know the means of payment? They have issues if they don't know the most basic of things like how they got paid.

rocky1234 07-05-2012 10:23 AM

paypal sucks.

Anyone with $100 can start a hosting company and most people lack the basic intelligence to keep it running.

I had this issue with something that I bought from a vendor through PayPal. I told him either finish the work or I'll contact him and his response was "there's nothing you can do, it came from paypal and its virtual money." Little did he know it came from my Amex which was quickly reversed :2 cents:

marktruman 07-05-2012 08:14 PM

mine came from my paypal balance, so there is nothing I can do :(

marktruman 07-09-2012 02:06 AM

amazing, paypal said contact the seller to resolve, yes but they wont reply.. morons

At the mercy of paypal on these virtual goods. crooked hosts can take thousands with no payback

klinton 07-09-2012 06:52 AM

very interesting.....:(

martinsc 07-09-2012 07:10 AM

:Oh crap :Oh crap

edelivery 07-09-2012 07:24 AM

Scotch, Matches, Gasoline, and a airline ticket ;)

Burn down their DC!

FYI...You can charge back with your CC, just call your bank.

Worst case, small claims court. Paypal folds quite easy when threatened with a law suit.

edelivery 07-09-2012 07:49 AM

Since I am in a great mood today, and I hate seeing people have a bad start with a hosting company...You can hit me up via e-mail or skype and let me know your needs.

I will give you the first month @ 200, and 379.99 a month there after.

If you only need a VPS and do not plan on heavy b/w, I may be able to give you a month 100% on us ;)

(we own all of our gear and our data centers)

Kenny B! 07-09-2012 08:11 AM

Two words... Mojo Host!

Thanks for the warning though.

GARY LEE 07-18-2012 04:31 PM

I don't know about your specific problem but I had a problem with a scammer site called socialadr. They took my money and delivered about 1% of what they promised. All internet related and paypal went to bat for me and made them credit my card 100%. My money was returned and all I had to do was tell Paypal about these guys.

bluebook18 07-18-2012 05:05 PM

careful with those people who are making promises because it will end up breaking your balls, the point is don't believe in magic

Try PayPal again, that just doesn't at all seem a right response from them. Post on WebHostingTalk.com and that will get their attention, probably.

Easy...EliteSwitch is simply reselling servers and hosting accounts. That's all.

Not sure what you're saying.

Barry-xlovecam 07-19-2012 04:23 PM

It means you give his grantor(s) shit and they pass the shit dowwards onto your adversary. As an example, when in a dispute with a large corporation I will send certified mail about the problem to the Chairman of the Board, his secretary usually passes the message down to the right person within the corporation to resolve the problem. When the COB's office asks you to jump you ask; "how high sir?"

In the case of a contracted party, i.e.; a reseller -- the message will get immediate attention as the contracting party wants to preserve its good relationship with its better. Easier to resolve the problem then get into a long go-round with the granting party i.e.; the ISP.

The shit flows downhill method almost always works. The VP at MCI taught me this when I worked for them 30 years ago.

Fuck Paypal if they can't or won't help you resolve the situation. Go to or call your bank asap and charge that shit back. After you get your money back, only do business with reputable hosting companies that everyone has at least heard of before :2 cents:
