1) If the content is something she shot for a web site that you are promoting then she can't claim infringement. She doesn't own the copyright to the content in that situation, the site/program does.

2) If you're using a domain that includes her name THEN she may have a valid trademark claim.

Situation 1 - I'd make him file a formal DMCA and in the mean time contact the program that actually owns the content.

Situation 2 - I'd take the site down and cut your losses. You might able to fight it, but it's likely not worth the hassle.

If she is smart enough to trademark her name and create a brand with an attorney then I wouldn't disregard the notice because, for one, you just publicly acknowledged that you were noticed which means you can't claim that you didn't know about it. So, now, if you do blow it off and it is legit you stand way more to lose. :2 cents:

the problem is that there is several reasons to think that it's not legit:
- the .edu looks like a joke for me
- what the link between this guy and the model ?

It would also stand to reason, and should be considered, that if she is smart enough to trademark and brand herself then probably she had the foresight to read her contracts and know what rights companies do or do not possess when it comes to publishing her content.

The trade mark has been filed, its not granted. It was filed in Nov of 2012 thier is no way its final. We filed for one at the start of Oct in 2012 and it just now made it to "published" in the gazette so its thier for 30 days before it goes to the final stge and thats only if no one contest it.

Its a edu domain thats a red flag fake.
