Doesn't sound like rape to me. Sounds like someone chose to do something she didn't want to do, and trying to convince herself that she's a victim of someone else as a result.

While what the guy did was wrong morally, I think it would be a not guilty verdict.

Reason; They'll take into account the age of consent in her state, his age in relation to that, and also the vital tidbits of her statement such as "I didn't say no out loud" and "he did nothing to scare me"

The only thing he failed to do was coddle her to the degree of asking her over and over throughout the encounter if she was into in and wanted it. No teenager full of hormones making out with another teenager, presumably a hot one, is going to stop unless the girl vehemently stops him and says no with both her words and her actions. Then and only then if he continues is he going to (hopefully) get the book thrown at him.

But if it were my daughter I'd still want to kill the guy. Then again I'm pretty sure I'd have already had the talk with my daughter thus she'd be well aware of when to say no and how loudly to say it.

16 is underage in most places.
And once that fact is established, nothing else matters.
She could have begged him to do it and even lie about her age and the guy
is still guilty by law because she cannot "legally consent".

The way the law works; claiming an underage consented is equal to saying the blind guy saw me. It is legally impossible.

Where I live, CDSmith would be correct. The age of consent here (and actually in all of Canada and most states in the US) is 16. Also, there are usually provisions that both parties cannot be separated by more than a given # of years.

And about age, i dont know where it happens and what laws do you have, but still its sex with not so young minors (plus he is 19) and not a rape...

Yeah, there are certain statues that include such things as difference in age;
but if anyone is deciding who to fuck based on understanding the current rules
of a law that seems to keep changing is crazy.

In many places in the USA, this case is straight forward guilty.

And there you have it, which is what I based my earlier comments on.

Cases such as these are not quite as clear-cut as some would like to believe they are.

So SHE goes to his house with intentions on making out, they fuck and now she feels guilty and wants to even consider rape... fucking woman lol And 19 and 16 is only 3 years people. Granted in the US it's against the law.. but I personally don't see a problem with that.
