11 Facts About the Eric Garner Case the Media Won't Tell You
 
1. There is no doubt that Garner was resisting an arrest for illegally selling untaxed cigarettes. Former New York City Police Commissioner Bernard Kerik put it succinctly: "You cannot resist arrest. If Eric Garner did not resist arrest, the outcome of this case would have been very different," he told Newsmax. "He wouldn't be dead today.

"Regardless of what the arrest was for, the officers don't have the ability to say, 'Well, this is a minor arrest, so we're just going to ignore you.'"

2. The video of the July 17 incident clearly shows Garner, an African-American, swatting away the arms of a white officer seeking to take him into custody, telling him: "Don't touch me!"

3. Garner, 43, had history of more than 30 arrests dating back to 1980, on charges including assault and grand larceny.


4. At the time of his death, Garner was out on bail after being charged with illegally selling cigarettes, driving without a license, marijuana possession and false impersonation.

5. The chokehold that Patrolman Daniel Pantaleo put on Garner was reported to have contributed to his death. But Garner, who was 6-foot-3 and weighed 350 pounds, suffered from a number of health problems, including heart disease, severe asthma, diabetes, obesity, and sleep apnea. Pantaleo's attorney and police union officials argued that Garner's poor health was the main cause of his death.

6. Garner did not die at the scene of the confrontation. He suffered cardiac arrest in the ambulance taking him to the hospital and was pronounced dead about an hour later.

7. Much has been made of the fact that the use of chokeholds by police is prohibited in New York City. But officers reportedly still use them. Between 2009 and mid-2014, the Civilian Complaint Review Board received 1,128 chokehold allegations.

Patrick Lynch, president of the New York City Patrolmen's Benevolent Association, said: "It was clear that the officer's intention was to do nothing more than take Mr. Garner into custody as instructed, and that he used the takedown technique that he learned in the academy when Mr. Garner refused."

8. The grand jury began hearing the case on Sept. 29 and did not reach a decision until Wednesday, so there is much testimony that was presented that has not been made public.

9. The 23-member grand jury included nine non-white jurors.

10. In order to find Officer Pantaleo criminally negligent, the grand jury would have had to determine that he knew there was a "substantial risk" that Garner would have died due to the takedown.

11. Less than a month after Garner's death, Ramsey Orta, who shot the much-viewed videotape of the encounter, was indicted on weapons charges. Police alleged that Orta had slipped a .25-caliber handgun into a teenage accomplice's waistband outside a New York hotel.

There is another video I saw this morning about a white police officer "harassing" for "having their hands in their pockets". The video shows the officer asking questions and the man saying "You cannot arrest me for having my hands in my pockets". It looks bad.

But the full story is this man was pacing in front of a store and acting suspicious, and the store owner got nervous and called 911. The police wasn't harassing anyone - he was responding to a suspicious person call.

Somewhere along the line it became acceptable to not respect police officers. I am not sure where any of you grew up, but police officers are almighty - No one can fuck your life up as quickly as a police officer. They can wrestle you to the ground, put cuffs on you, throw you in the back of the car, and before you know you it you are bent over the jailhouse sink having your asshole widened by your new cell mate while screaming out "Mommy" at the top of your lungs.

I'm not saying police officers are saints or never wrong but they can turn your life upside instantly.

This man didn't die because of a choke hold. He died because after dozens of arrests he still didn't learn something as simple as "respect". That and his four hundred pounds killed him.

It's true that the choke hold may have contributed to his death - But no more than anything else that happened - The guy had a heart attack bought on by the stress of the situation that he can only blame himself for...

I feel like the cops could have explained to him that they're placing him under arrest, or that they just need to talk, and that he needs to put his hands behind his back so they can cuff him.

They just sort of grab at him, he flinches, then they sort of sneak up and pounce on him.

He wasn't running. He was talking to them.. Why not talk it out a bit more instead of trying to make an aggressive move at an obviously huge guy like that?

I've seen lots of great cops talk people down. People get upset, it's an unsettling situation.. Give a guy like this a minute to process his choices and calm down. There was no real dangerous element here.

Classic case of minor problem turning into many major problems because of bad decisions on both sides.

It sure does seem silly that a store owner would feel "threatened" by someone walking around with their hands in their pockets, and it's entirely possible the store owner was the wrong in the wrong or had bad intent.

But it was the way the guy was talking. Any time a cop talks to you, you should say "yes sir" or "no sir". This guy was kind of combative although it ended well.

Again, not all cops are good. But you be respectful, give them as little info as possible, and get away from them as soon as you can.

Actually store owner later said that wasn't the guy he saw walking back and forth.so this guy did nothing wrong.

There is no "may have" about it. The coroners report states that his death was due to compression of the neck and it was ruled a homicide. In addition to that, his chest was compressed with hundreds of pounds of cop on top of him. It's easy to find online so no guess work required. He was killed during his arrest. And that's that. Is that OK or not?

Plenty of people chime in about personal histories of the dead men and I want to know who gives a flying fuck? Can cops kill people they are trying to arrest or not is what we should ask our society. I say no they may not, and if they're so cock sure that it was accidental then they can tell that to a jury while they're on trial for causing the death. So far they take the more easy route of grand jury's which is certainly what I would want too. Absofuckinglutely.

So anyway, does being choked to death by cops make you feel stress? I would guess so if I had to guess. Should cops who know they are about to confront someone who is huge and might resist bring along.. oh I don't know.. several tasers? Yeah probably. Wouldn't look as cool though? Here is the problem; you seem to think that means something special. The FACT of the matter is that there really was no question whether or not he died at the hands of another (which is what a homicide is), the question was, was it a crime since it was done in the course of a cop doing his job.

The grand jury, who saw a lot more evidence than you, deemed it wasn't.

The guy was still speaking while being in the hold, so he was not a choke hold. Bottom line don't disrespect the police, just do what they say. Put your hands out, make them comfortable, they have the power to take your life. Stand still and be calm and you'll live another day.

Seems to me he was "unresponsive" at the scene. He might have died on the way to the hospital, but it was the arrest that did it. You can blame this one choke hold all you want, but when six police officers wrestle a four hundred pound man in poor health already down to the ground... Well....

The media has a lot to do with this too. Micheal Brown might have been a teenager, but he was also a two hundred and eighty pound man - that's a far cry from what we consider a teenager. This shit that went down in Phoenix is the same thing - The headline reads "another unarmed black man shot and killed" and show a friendly looking man in a santa clause hat but fail to mention he was selling drugs and had a shotgun in the car.

One of the biggest issues is the lack of Knowledge of what actually happened.

The Median loves to use the phrase " Choke Hold " when in reality this is what was done.

The lateral vascular neck restraint is still a widely taught and utilized blood restriction hold in law enforcement[citation needed], and can be performed from behind the suspect (or from the front when the officer is "on top" of the suspect) by putting an arm around the neck of the suspect, with the crook of the elbow over the midline of the neck. This is different from a chokehold, in which the larynx is blocked by the arm. By pinching the arm together while assisting with the free hand, the carotid arteries and jugular veins are compressed on both sides of the neck. This hold does not put any pressure on the airway, but an improperly applied hold could quickly turn into an air choke if the person being restrained resists the hold by attempting to turn around.[7]


How ever when the guy was fighting he most likely turned in the hold and cut his own airway to a minimal amount which in the long run caused the heart attack.

Yea that's right fagdog and I deem the grand jury got it wrong, why? Because I saw the video with my own 2 eyes of the cop putting a chokehold on the guy while he's gasping 'I can't breathe', then the coroner's report stating the cause of death was chokehold.

Ive dealt with the nypd my whole life. Ive been arrested and put in a choke hold my damn self for "tresspassing" in the building I lived in. Theres a reason niggas (regardless of race) flinch around the nypd. Im missing 2 teeth from getting wacked with a flashlight by an nypd officer for digging in my back pocket to get my ID that he asked for. This aint a race issue, this an abuse of authority issue. White people get it too out here.

You do know that this stops blood flow to and return from the brain and no blood to the brain for a short time can cause death or stroke?

If you want to kill someone fast: slash their neck, the blood no longer gets to the brain ... They die of brain death before they will bleed out.

Eric Gamer died of a cardiovascular event -- the brain stem controls autonomous functions such as heartbeat and respiration rate.

Depends on when you are talking about. Past police departments from the 60s, 70s, and 80s were pretty much corrupt and feared. I am sure this still exists in some areas, but it's not like it was twenty or thirty years ago.
