Roofer faces charges for taking back client’s unpaid roof

MONROE, La. — A Louisiana roofer faces misdemeanor charges after repossessing a roof because he hadn’t been paid.

Authorities arrested 66-year-old Andrew Jackson Higdon III, of West Monroe, Tuesday on charges of simple criminal damage to property and criminal trespass. The News-Star reports Higdon was freed after posting $4,500 bond.

The arrest warrant says Ouachita Parish deputies responded Dec. 29, 2016m to a property damage complaint. The victim says Higdon verbally agreed to replace her roof in June and wait for payment until her insurance company issued a check.

The victim says Higdon started asking for payment around mid-December. She said she could partially pay, but he wanted the full amount. She says he told her if she didn’t pay, he would take the roof and her house would be damaged when it rained

If there's one group of tradesmen I wouldn't mess with, roofers would probably be at the top of that list :1orglaugh

It’s tantamount to not paying your mechanic. Your car will be returned, just not the head gasket or engine!

If that roof leaked or he left holes there, the damage must be significant . Homeowner was dumb to hope she got paid di she could pay him. Get a loan, use a credit card or do a simple patch.

I used to own a glazing company, if someone didn't pay, legally you couldn't take the glass back, but you could leave it as you found it.

So after making sure they weren't going to pay, you'd just put your hammer though the glass, and notify all glaziers in the area that they client was a non payer.

Nope, not in the UK. You can't remove the glass, but you can leave the window in the state you found it.

UK regs protect the consumer and rightly so.

Otherwise the trader has too much power and the consumer can be gouged.

e.g. What is to stop an unscrupulous garage owner from charging $10000 for replacing a $10 part on a car and then refusing to return the car until the bill is paid.

Any tradesman has to follow the correct legal procedure in the event of a dispute over payment, otherwise little old ladies would be at the mercy of 12 clicks and his ilk.

The roofer agreed to wait until the insurance company paid. He should be made to repair the roof for free.

They had an agreement and he broke it. He knew the money would be delayed but wanted it when he wanted it. Part of me feels bad for him but a bigger part thinks he just got greedy and stupid.

He wasn’t that broke if he could pay the $4,500 bond
