The porn industry has been around for a while and in today’s digital age business is booming. When Laurie Schlegel isn’t seeing her patients who struggle with sex addiction, she’s at the Louisiana State Capitol. The Republican state representative from Metairie passed HB 142 earlier this year requiring age verification for any website that contains 33.3% or more pornographic material. “Pornography is destroying our children and they’re getting unlimited access to it on the internet and so if the pornography companies aren’t going to be responsible, I thought we need to go ahead and hold them accountable,” said Schlegel. According to Schlegel, websites would verify someone’s age in collaboration with LA Wallet. So, if you plan on using these sites in the future, you may want to download the app. |

A US state is now forcing people to provide age verification to watch pornography, thanks to a new law that goes into effect tomorrow (1 January 2023). Louisiana will now require people to verify their age if accessing websites containing at least a third of pornographic material. It will be the website's responsibility to confirm that users are aged 18 or over. HB 142 - the law requiring age verification for any website that contains 33.3 percent or more pornographic content - was introduced by Republican state representative Laurie Schlegel earlier this year, having been signed into law by Gov. John Bel Edwards in June. She said: “Pornography is destroying our children and they are given unlimited access to it on the internet. So if the pornography companies aren’t responsible, I figured we need to go ahead and hold them accountable.” Sara Kelley, project manager with Envoc - the creator of LA Wallet - said the app was a 'must have' for 'anyone who has a Louisiana state ID or driver’s license'. She told WAFB that there are other ways that websites may ask users to verify their age if they are not able to access LA wallet, adding that while some personal information will be required, companies should not retain personal data after the verification process has taken place. Kelley explained: “It doesn’t identify your date of birth, it doesn’t identify who you are, where you live, what part of the state you’re in, or any information from your device or from your actual ID. It just returns that age to say that yes, this person is old enough to be allowed to go in." Schlegel - who is also a certified sex addiction therapist - said someone could 'sue on behalf of their child' if children are gaining access to pornography. |

By the sounds of it, if you do not drive or happy to use the app, them you are stuffed. In other words, if your poor you will be restricted. I am not sure what the state laws are like in that state, but it may in fact be easer to buy a gun than see porn. However... I suspect few sites will comply, and it will flop. Also the fact that a single app has what seems a monopoly on the situation sounds a bit fishy. I wonder what they charge businesses to use it. The interesting thing is, this seems to have gone past with little reporting. As I say, I suspect we will find this law fails, but it will be interesting. I would have presumed this law may conflict with the freedom of speech laws of the USA. As I would presume you could not say you have freedom of speech as long as you have id, ad=nd happy to provide it as if you are in the USSR. |

Porn has been around since cave man times.
Deaths from porn in all that time = 0 Yet look how many deaths from drinking and smoking, and lives messed up with gambling. In the UK several people die each year from just getting dressed. Then the churches will say they must protect children by banning porn, while they themselves were abusing children. |

But US adult industry campaigners argue the law is the wrong solution. Age checks are also a key part of the UK's Online Safety Bill. Under the Louisiana legislation, most users are expected to use a smartphone app, called LA Wallet, to show they are over 18. The app requires a driving licence or an official state identity card to establish a person's age. Users of one of the largest pornographic websites, Pornhub, are now directed to an age verification process, according to a video posted on Twitter. "Louisiana law now requires us to put in place a process for verifying the age of users who connect to our site from Louisiana," the on-screen text says. The message also says that the site "guarantees" it does not collect data during this process. Not retaining data is written into the bill, according to an official summary. A check on free speech? The law does not make it illegal to allow children to access pornographic websites, but enables people to sue sites that do not have age checks. A federal law giving regulators the power to mandate age-verification country-wide was proposed last month by Republican US senator Mike Lee, from Utah. The Shielding Children's Retinas from Egregious Exposure on the Net Act would make US regulators require sites to age-check their users. But some lawyers question whether the Louisiana legislation is compatible with US constitutional protections for freedom of speech. Campaigners note a previous law was ruled unconstitutional by the Supreme Court. Mike Stabile, of the Free Speech Coalition, which campaigns for adult industry rights, told the BBC: "We should all work to prevent access to adult content by minors, but the simple, free filters available on most devices would accomplish the same thing." The legislation was a dangerous step towards censorship and should be seen in the context of an effort by conservative and faith-based groups to "remove sex and information about sex from the public square", said Mr Stabile. Ms Schlegel says she is a "certified sex addiction therapist" including "addiction" to pornography. The legislator told USA Today the bill was not designed to prevent adults from accessing pornography, but was just about protecting children. Ms Schlegel said she was inspired to act by Eilish, who said in a 2021 interview she watched pornography from age 11, and felt it helped her to be "one of the guys". Eilish said the experience led her to "not say no to things that were not good" when she began having sex. Private data In the UK, the Online Safety Bill, which is currently progressing through Parliament, will order pornographic websites to prevent children from accessing explicit content. Previous legislative efforts have been abandoned and many privacy campaigners argue age verification systems can be easily circumvented using virtual private networks. An Ofcom report last year found one in 20 children (6%) already got around parental controls restricting access to certain sites. And critics say such systems collect large amounts of highly personal data about people's sexual preferences. Jason Kelley, of digital civil liberties group the Electronic Frontier Foundation, told the BBC: "Age verification systems like those required by the Louisiana law force users to hand private data over to a third party simply to use a website. "There's no guarantee that this data won't be retained." But providers of age check systems disagree there is a privacy risk. Ben Keirle, of UK-based age verification platform 1account, said all that an adult website would see using its system "is a simple yes/no response to the request to verify a user prior to admitting access". He said information used to prove age was deleted once a person was validated and was in any case not stored by the platform and was never made available to the adult website. |
