Starting up in the EU
 
Hey guys,

I need help. I have a site ready and hosted in Amsterdam and I live in Spain, but do not know how to fix the formal company parts with bank accounts etc. I cannot find ANYONE to help me out with this as everybody says that the adult industry is sensitive, you will get sued, no bank will take your money etc etc etc.

Can anyone please help? This is probably helpful for a lot of other users as well I can imagine.

Try xolo.com for accounting in Spain. Just dont say how you do adult,it's not like they actually verify that.

Hey. We're a tech startup based in NL, so we know how it works here and might be able to help you out.

Can you provide some more details about what you're trying to do? (Why) do you want to register a Dutch company / bank account? Are you doing B2B or B2C?

Try to make a marketing company for online biz etc and just work with it. Also try to find someone from Cyprus or Bulgaria and Malta I think, will helps u.

Hi again! We are also a tech company who have built the site with everything ready B2C.

The only thing we need to get started with the site in production is the underlying "business infrastructure" so to say, with company bank account etc.

We already have our own Spanish company, but for our "normal" day to day business, and we have been told not to use this for the adult site due to risk of lawsuits etc etc etc.

Okay. You're gonna want a BV ("Besloten Vennootschap"). That's a legal entity that's fully separate from your current one, and can simply be owned by your Spanish company.

You'd have to work with a notary to create articles of incorporation and then register with our chamber of commerce.

I think there are companies able to help you with this, like firm24.com/en/incorporation-bv/ or ligo.nl/en/incorporate-dutch-bv (I've never worked with either, but it looks like they might handle everything for you, which is nice.)

Muchos sitios grandes operan desde España.

Si lo que quieres es opacidad, abre una empresa en alguna jurisdicción offshore.

If you cant figure out how to open a company I have a bad feeling about your ability to thrive in this industry.

Anyhow Netherlands is not the jurisdiction I would choose if you just need something anywhere in the EU

Any bank is ok for an adult business, you should ok setting up an account with Santander or Sabadell. We´re with Sabadell and a local accountant shall help you set up your autonomo and accounts, if creating content, you´ll need to pay vat & tax :2 cents:

Great stuff to speak to someone actually running business in Spain! Thanks for your input! I completely understand on the VAT and tax, this is our full intention as is normal.

When looking at your sites it says the company is from Cyprus in your legal texts though? Is there a reason you are not stating your Spanish autonomo in all legal texts? Hope it´s ok to ask like this, we are just really trying to get the hang of this ;)

Why not to open a company outside of Spain or even EU? Your website is global anyway.
I would choose company in the USA.

It sounds like you are over complicating the situation.

First thing is, you are probably best to use a USA host as it will probably be cheaper and less problems. Some non USA hosting firms do not allow adult, and such as France are making porn harder to access, I would not host in the EU or even UK (as they keep trying to bring in anti porn laws).

As for a bank, this should be no problem as long as what your doing is legal.

Most people just have a personal account and pay money into it. Or set up a business account. Again it should not be a problem.

In truth, your main problem is making money. Many think doing porn is easy cash and have a shock when they make nothing.

Because that Cyprus address is the host/payment system.

He uses as I do use modelcentro to host and do everything. If your plan is to run a paysite, this is the easy option as they host everything. All you do is upload content.

Thus the Cyprus info is presumably where the firm or the payment side is registered.
