Should ACACIA win...
Do things the American way, recoop your damages by suing your enablers.
Tobacco companies... sued for the results of using of their products. Gun Manufacturers... sued for the results of using of their products. McDonalds... sued for the results of using their products. Why not MS, Adobe, Macromedia, Sonic Foundry, etc... ? They are the ones that enable you to output your videos in a streaming format... Then, MS, *nix, and all the other companies that sell the server software that enabled you stream, or make video files available. Then MS, Winamp, and all the other software companies that make software that allow people to view streamed or downloaded video. and so on... |
I was thinking about this too and it does seem that Microsoft could be sued for licensing you a streaming server if they don't have the legal right to license you the technology.

If Acaia were to win, trust that is exactly what would happen next.

If I "license" you a technology which I don't have the rights to and you get sued, can't I sue you for the money back that I paid you and the damages I have to pay to the person suing me? |
Maybe if those companies started seeing a sudden influx of lawsuits from people who bought and used their products as perscribed, they might be inclined to put their collective foot on ACACIA's throat.
