The reason I talk about this.. On March 28 I was sued (pocket service) no actual court yet by a law firm representing a certain credit card.

In MN you can be sued by a simple complaint. It cost $300 to answer it. If you do not answer in 20 days they can go to court and get a default.

So the default does them no good as I am exempt 100% BUT a judgement remains for 10 years.

The bright side. As I said BR trumps all judgements and I will qualify for EA (Energy Assistance) again this year as well as BR for at least next year.

The means test. $3400/month in my county. Under that and you qualify for BR. So no worries.

But I did a TON of studying on all this.

So maybe that is why I am a little testie. Although I KNOW my ass is covered it is a strange experience having a process server show up one day. :) Tho of course they were threatening for awhile but cant bleed money from stone. If I dont have it I dont have it. :)

The lesson learned? KNOW that IF you can not pay your credit cards due to a sudden loss of income, they WILL take you to court, get a judgement. (which also automaticly puts a lein on your car and home and all other real property)

with this judgement they will take your house (exempot up to 200,000 in MN) Your car(s). You can have one car exempt up to only $4300. You can have up to $11,000 tools of the trade. So ok there. Ect

The point is THESE sweet and friendly credit cards WILL play hard ball and RUIN you if you can not pay them back IF you have property, cash, stocks, bonds ect over the exemptions.

The lesson. Cash only. Get rid of all cards before it is too late.

That balance you are carrying (maybe $10,000 plus) is like a boulder hanging over your head. Dont pay them andd they will crush you.

And YES I payed back my principal AND about 100% interest over 10 years BUT due to the nature of interest was never able to get the principal down.

My mistake: I feared them and spent all my cash I had trying to pay them off even for 6 months when my cards were pegged.

They are absolutley the scum of this country with their 20%+interest rates which are almost impossible to pay back.

Afterall IF you could pay it back you would not have borrowed the money to begin with.

Someday i will build a site and educate the American public on what to do should you not be able to pay your CCs someday.

Ya know NY is one of the few states (actually the only state) to lock up the first I think $2500 in a bank account and keep it insulated from all garnishment.

All other states this shit happens and you have to say bye bye to the bank account and go cash only.

Even IF you are dead broke and have only $500 to your name but in a bank acct, they can and will take it leaving you penniless. Bank accts are not exempt and very hard to get your money back.

And in MN only (where we suck) they can do it before they get a judgement tho the judge must sign off and "probably" wont if you are a poor working person like me who presents no flight risk.

37,000 "pocket service" suits in MN were filed in one year I think 2009 and with many they hit the bank acct before they ever get a judgement. Only in MN. Other states they MUST have a judgement to get a bank acct. NOT in MN.

Yes there is AFTER paperwork you might get some back but bank garns are the bloodsucker's easy pickens and what they are after.
