McCain is clearly American by birth right. American citizenship does not necessarily require being born in America. Canadian-American Republican Senator Ted Cruz from Texas (and possible presidential candidate) knows this well. He was born in Alberta, Canada to American parents yet he is also American by birth.

By the same reasoning Obama being born to an American Parent had no reason to have his eligibility/status questioned.

EDIT: Based on Wikipedia that quoted law about citizenship came as a law a year after McCain's birth, and he was made as a citizen ex post facto. So the argue has not been about the law per se, just that he did birth before that law. But as he got citizenship ex post facto, there is no fucking problem.
