The C&D we received didn't have as much to do with the game (which is a legally purchased Monopoly game with stickers placed on the board) as it did with the image that we used on our tourny site and the fact that we were calling it a Monopoly Tournament. The C&D didn't specifically say that the games were a violation of trademark... it was the image on the site and the use of their name. We should have vetted the idea better... that is a given... but the real kicker is that there probably wouldn't have been a problem at all if some GFY know-it-all dickwad didn't decide to play Hasbro policeman. |
