I better clarify a few things. I should know as I got the idea for the tournament and also made the agreement with Hasbro.


We received a cease and desist letter from Hasbro.
They wanted us to:
  • Cancel the tournament
  • Destroy the produced games
  • Never create a game based on Monoply again
  • Pay 5000 euro for damages


We settled on:
  • Run the tournament one time only
  • Only give the already produced games away for personal use only
  • Never create a game based on Monoply again
  • Pay 3000 euro for damages


Originally we had plans about selling the games afterwards so affiliate programs could use them for gifts for their affiliates. We will not sell games now.

There is produced 22 games, most of them was given away to the winners of each round during the tournament.

Congrats on your negotiating with them. It sounded like a great idea and concept, just the second i looked at it I thought no way in hell this can fly with a company like Hasbro, they would be sueing people etc... Sucks the person that got you involved with it lead you to believe it was ok. Concept is good. If you changed the board around and didnt copy their exact layout, didn't use "opoly" in your name and just made your own game with similar rules you would be 100% fine and still accomplish the same goal.

He was mistaken... originally we had thought we would sell the game because we were advised by the maker that it was legal and there are other games being sold that are similar like http://www.stripopoly.com but obviously we can't do that now. The C&D we received didn't have as much to do with the game (which is a legally purchased Monopoly game with stickers placed on the board) as it did with the image that we used on our tourny site and the fact that we were calling it a Monopoly Tournament. The C&D didn't specifically say that the games were a violation of trademark... it was the image on the site and the use of their name. We should have vetted the idea better... that is a given... but the real kicker is that there probably wouldn't have been a problem at all if some GFY know-it-all dickwad didn't decide to play Hasbro policeman.

You are right, that is confusing.

The original intention was to sell games after the tournament.
That will not happen now.
