It SHOULD be legal to write about anything you want. Fiction is fiction. Thinking about nasty acts and writing about them are very different from doing them or compelling others to do them. That being said... anyone who thinks erotic stories are fully protected by freedom of speech should take a long close look at the Red Rose case....

That seems to be a special case though, a person without a fear of going into public would have fought for their first amendment rights.
