what cms is that, the source codes of the sites don't look like copies, and the site itself just looks like a typical tube type layout with a black background and orange lettering? there are tons of sites on the web that look similar to each other, it would be a bad precedent to allow a lawsuit like this to intimidate someone into changing their layout
