As for it being the same person, RKNet Media isnt even challenging that its the same girl. Therefore, its safe to assume that she is one and the same...

As for the other issues raised by RK, they are using the fact that she presented two valid forms of ID as the basis for their defense.

Interestingly enough the plaintiff's attorney didnt allege any rights to publicity claims in the Complaint which might have saved it. They really only allege the statutory rape and child porn as the basis for their lawsuit. A minor cannot sign a model release or any other contract without parental approval or the contract can be voided by the minor.

RK might win their motion to dismiss. However it will probably be without prejudice and plaintiff's attorney will have a chance to correct their mistakes and refile (However I do not know Florida Civil Procedure). If they do win the motion with prejudice its game over for the girl and her mom.

RK filed their motion March 7th so it shouldnt be too much longer until the court reaches a decision....
