GRHK LLC, operators of DancingBear, had been seeking the identities of FapZap's operators in a letter to its hosting service Choopa and filed with the federal court in Miami.

In the letter to Choopa in August, GRHK said that it had become aware of 18 videos on FapZap that were poached and streamed on the tube site, including such titles as "Dancing Bear — Crazy Party Girls," "Dancing Bear — Fucking in the Club" and "Dancing Bear — Dick Dick Goose."

"[W]e request that Choopa remove or disable access to the attached claimed infringing material as soon as practical after receipt of this notification," the letter said.

Two days after serving Choopa with the letter, the case against FapZap was terminated and now FapZap.com redirects to DancingBear.com.

On Wednesday, the attorney of record for GRHK in the claim, Marc Randazza, would not confirm nor deny terms of an apparent settlement to XBIZ.

FapZap, according to archived pages, claimed to be "one of the world's largest free porn tube resources"; it currently ranks No. 22,371 on Alexa. The site had been operable as a tube site for less than a year, and it is unclear who owned the site.

DancingBear, also known as "Tale of the Dancing Bear," features stripping bachelorette party sex; its Alexa ranking is No. 3,202

it wouldn't stop but it would be held in check, that is for sure.

Still waiting for the first tube site lawsuit where they sue "john doe" defendants, subpoena the site for their records and go after the people who actually uploaded the content ( in some cases this will be the tube site themselves.) The uploaders can't hide behind DMAC and if the site doesn't comply with the subpoena they will be fucked. When they do comply they will piss off all of their "uploaders" / users. Either way its a big win / win. I am still surprised no one has tried this approach yet.

i discussed this with my lawyer who goes after torrent users and he said it's too expensive. if you went after one person who uploaded a video to a tube it could cost you $5K-$10K only to find out the IP is in a country that protects him from this kind of stuff.

the tube owners upload most of the content themselves so i'm sure they have a way of getting around that, possibly through a proxy server so it would be a huge waste of money.

I don't see why it would cost so much to subpoena a tube site owner to turn over all of the records when you provide them with a big list of the videos that were stolen and uploaded. You then shake down the list no different then they do with the torrents. If the user ued a proxy you just move on to the next one. The point is that you turning up the heat on them, you forcing them to comply with the courts or face the legal consequences and you pissing off their members because the tube site is turning over their information. shake the tree enough some apples will fall out.

Yes it WAS one of the world's largest tubes that hosted absurd amount of stolen content, probably even more than xvideos.

They're still in RYC's top infringing tubes despite being closed for more than a month. Their boasting was not that out of touch as you believe it was. This message was aimed at surfers, not webmasters, and surfers do not care what traffic rank a site has, they want lots of stolen full length clips and fapzap provided plenty.

They were not the biggest tube traffic wise, yes, but they were climbing fast until taken down by DB.

22K is not their actual rank. Their rank is ZERO now because they're closed. 22K is a 3 months average. It was close to 5K about 2 months ago and climbing, it is zero now. 22K average is a meaningless figure.

Outside legal time, the cost comes in when you need to file a separate lawsuit against each uploader. As I understand, you can not joinder all the uploaders because each upload and instance of uploading is different. Thus, filing fees times number of uploaders adds up quick.

Sponsors do a lot with piracy sites, they advertise on them and give them content.

The problem is ROI. Suing one and closing them, means all the traffic on that piracy site moves to another piracy site. So, spend a lot of time and money to get no where. It's cheaper and more productive to stick an advert on a piracy site.

Ethical? NO
Logical? A VERY BIG YES.

That's the situation of online porn. The solution isn't to sue one so anther takes it's traffic.

So what is the solution? That's a very tough question to answer.

Maybe a better product more suited to the buyers needs. And getting that with the cost of traffic is going to be hard.

Otherwise there's none. Sorry to be so negative, but if no one can come up with a better reason to buy porn. Then surfers will continue to go for the free option.

DMCA is not what I was talking about, you never going to win or accomplish anything by having to search the entire internet every day to try to find people stealing your videos and then sending out thousands of DMCA letters everyday.
