John Stagliano being sued - GoFuckYourself.com

A popular porn star who appeared in the movie "Buttman's Stretch Class #4" is suing the male lead (Buttman) ... claiming he failed to disclose that he was HIV positive before they shot sex scenes.

The woman behind the lawsuit is Katie Summers -- real name Katherine Howard -- who claims she was paid to appear in the film back in 2009 ... and the role involved sexual interaction with John Stagliano (aka Buttman).

In Katie's lawsuit, filed in L.A. County Superior Court and obtained by TMZ, the porn star claims Stagliano had known he was HIV positive since 1997 ... but failed to disclose that information before they shot their sex scenes for the movie.

FYI -- Stagliano has been open about his condition for years.

Still, Katie claims she didn't find out about Stagliano's condition until 2012 ... 3 years after they shot the movie.

In her suit, Summers does not say if she is HIV positive.

Summers is suing for negligence, intentional infliction of emotional distress and sexual battery. She's also suing John's production company -- Evil Angel Productions -- which produced the flick.

Summers is suing for unspecified damages -- and wants a judge to hit Evil Angel with an injunction forbidding the company from continuing to produce movies with Stagliano unless it discloses his condition to others.

first i didn't know Buttman fucked girls in his movies - been years since I saw one but I remember the ones I saw he was just a perv and would stick his face in girls asses not his dick.

secondly, these girls aren't porn fans before they get into the industry, and most of them even when they're in the industry aren't interested in the goings on and personalities of the industry - to her Buttman isn't some porn celeb, he was just another dude she showed up to do a shoot for. so it's very possible she only found out about his HIV long after she did the shoot.

This story could be a catalyst for the industry...and not in a good way.

What if this silly lawsuit proceeds to the point where Stagliano goes and gets tested...and the testing facilities show he's negative? Then what? Mass exodus of people leaving the industry could easily go down.

HIV is no longer a death sentence folks. It's more like a condition you live with for the rest of your life...like diabetes.

Stagliano may have a viral load so low a test won't pick it up. And that might come to light.

Then what?

Agree with others that it should be stated beforehand. There's a whole new generation that doesn't know how ground-breaking guys like Stagliano, Rodney Moore and Ed Powers were for their time. Or even who they are now. There's such a miniscule chance of contracting it, especially in those circumstances but all parties should be informed.

I think that he should as well as any other actress/actor should be required to be upfront about it but I also think the company that is doing the shoots should inform their stars that they are working with someone that is HIV positive.

This is an interesting case and it does have implications on the industry

In California you MUST notify any person you are going to have sexual contact with prior to. He didn't and she is suing him civilly (this is not at this time a criminal case) civil means only a simple majority of the jury must agree with her for her to win.

how hard will it be to convince that jury that this was "sexual contact" because how would they feel had it been them? My bet is that they would have wanted to be notified.

And Billy raises a VERY interesting point...John would almost certainly test non reactive for HIV using the current industry testing protocols. Karen admitted as much in AVN yesterday when she stated that John has been "undetectable for HIV for 15 years"

Bad timing on this whole thing...once again it underscores AHF's claim that we need condoms and cant be trusted to govern ourselves.

well look at the more recent situation with the talent who had conceived syphilis, then tested and allegedly attempted to falsify his test, he is also getting sued and i think he did time as well...
this could all be a catalyst for whats to come - ambulance chasing lawyers trying to find innocent porn girls willing to sue wealthy male talent (if they can find any)

however i do want to say that if Stagliano had sexual contact with Katie then he should have informed her, and actually imho he should never allow himself sexual contact with anyone who is not already infected regardless if the partner is willing or not.
