Pornhub and Allies Accuse Instagram of Double Standard After Porn Site’s Account Permanently Banned

You know all they had to do was leave well enough alone and stop trying to be mainstream. PH groans about not being treated fairly after they built their empire how?

Pornhub, the embattled adult-content site, lashed out at the decision by Instagram to permanently ban its account on the social network, citing Instagram’s practice of allowing celebrities like Kim Kardashian to post photos with nudity as an example of a double standard.

In an open letter addressed to senior execs at Meta (Instagram’s parent company), Pornhub — along with adult-industry trade group Free Speech Coalition, the Adult Performance Artists Guild and more than 60 adult performers — implored Instagram to “end all discrimination toward those involved in the adult industry” and to “immediately reinstate all accounts, including Pornhub, that have not violated any of Instagram’s Terms of Services.”

“We demand an explanation and guidance as to why our accounts are continuously deleted, and why content we spend money creating in order to engage with our audience is removed, even when we do not breach any of Instagram’s rules,” the letter said. (Read it below.)

The letter specifically cites a Sept. 6 Instagram post by Kardashian, one of the service’s most-followed celebs, that included a photo of her on the cover of Interview magazine’s September 2022 issue in which her nude backside is prominently displayed.

“Kim Kardashian has posted her fully exposed ass to her 330 million followers without any restrictive action from Instagram,” Pornhub and the others said in the letter. “We are happy to see that Kim and the artistic team behind the image are free to share their work on the platform, but question why we are denied the same treatment.”

The letter, posted on Twitter by Pornhub, is addressed to Meta CEO Mark Zuckerberg, Instagram head Adam Mosseri, Meta global affairs chief Nick Clegg and Meta chief legal officer Jennifer Newstead.

But while Pornhub claims it has not violated Instagram’s policies, a spokesperson for Meta said that Pornhub repeatedly violated Instagram’s community guidelines — including a ban on sexual solicitation — over the course of more than 10 years. The violations accumulated to the point where Pornhub’s Instagram account was permanently shut down, according to Meta.

According to Instagram’s community guidelines, “We know that there are times when people might want to share nude images that are artistic or creative in nature, but for a variety of reasons, we don’t allow nudity on Instagram.” In addition, Instagram adheres to Meta’s corporate-wide community standards, which regarding sexual solicitation forbids “attempted coordination of or recruitment for adult sexual activities.” Pornhub’s Instagram posts had featured videos like “Next Career Goal” encouraging people to become pornography performers.

Before Instagram disabled Pornhub’s account in early September, it had 13.1 million followers and more than 6,200 posts.

That came about one month after Visa and Mastercard cut off payment privileges of TrafficJunky, the advertising arm of Pornhub parent company MindGeek. That followed a federal court ruling in July rejecting Visa’s request to be removed from a case in which MindGeek is being sued for allegedly distributing child pornography and that alleges Visa knowingly facilitated MindGeek’s ability to monetize the illegal content. MindGeek says it has “zero tolerance for the posting of illegal content on its platforms, and has instituted the most comprehensive safeguards in user-generated platform history… Any insinuation that MindGeek does not take the elimination of illegal material seriously is categorically false.”

but @Nat, I think we just have to get used to the fact that these platforms hate us

I do fine w/o an insta account, as I'm sure you do as well. fuck 'em. making multiple accounts seems like a total waste of time if you create them, upload content and post the link on your other stuff...only to have them banned one by one

if you DO want to use insta I'd use it to attract clients via access to your life beyond your sex work. you obviously control the extent of that. you live in a beautiful place, my fellow sun and nature worshipper

you can post totally clothed pics of you at the beach, or anywhere you choose, so clients see the person beyond just a gorgeous and sexual exterior. those receptive to that will ABSOLUTELY pay for your content

that's been my experience at least

I think they're being sued quite a bit lately. A lawsuit FROM them probably won't do very well.

but for real, have you ever been a cammer or content producer? time is really fucking valuable and creating churn and burn accounts on any platform is time spent NOT making money

which is the primary goal. I just offered Nat some advice based on my experience, did not claim to be an expert

these platforms can do whatever they want, they are privately-owned companies and of course they kept that Kardashian chica cuz she's famous. for what exactly I dunno but that's beside the point

so for non-KK's who actually work in adult my method seems to be effective in attracting paying clients. again, dunno if it would work on insta but on other platforms it does

Zero chance that a pornographer can win a suit against any website for shutting them down.

Free speech arguments don't work because speech can be regulated by time, place and manner.
Instagram wasn't the correct place at this time for that manner of expression.

I don't know why it is such a meme to say these are private companies who can do as they please.

#1 Meta is a publicly held company.

#2 As a society, we've decided we are fine with hundreds of thousands of restrictions and regulations on what companies can do.

Not on you, Jesse, as this is said constantly.

zero offence taken mi'lady

I guess I misspoke, you're correct on private v public and regulations on companies

but point still stands that they can do what they want. like any court is gonna rule in favor of OUR rights? PH is disgusting, thieves who profited on theft and alleged illegal material now crying?

cry me a river

even if they sue and win a lawsuit do you honestly think it will benefit the smaller fish like us?

not trying to be combative, I just don't think PH is the right choice in leading a fight over the discrimination we experience. I hope I'm wrong

I mean for what it's worth IG banned one of my dental information accounts. It's not like anyone wanted to see pictures of teeth, but I think it's clear these fuckers play by their own rules. 😂

Not sure i even implied it's "free speech" arguments. There's various types of discrimination, and in today's time, anything seems to pass.
They have the money to sue. Get performers behind them. They have a case. Obviously it would probably end in a settlement, but a nice one i bet.

Dude, they are one of the biggest porn sites in the world and they promoted themselves on a social network used by millions of kids... You must be crazy to think they are going to win anything using the free speech or discrimination (LOL) argument

I am surprised that IG let someone create a profile called "pornhub" in the first place.

Remember their ads in Times Square? That would be illegal in many EU countries including those porn friendly ones. You can't advertise porn in front of kids. For years, they didn't even have a warning page - making porn available in public places accessible to kids can get you in jail for up to 3 years in Czechia, the European porn center (and 5 years in case of intent to make large financial gain) - that's why all adult sites owned by local companies use those warning pages. My point is the norms are different in the rest of the world and companies (including social networks) need to obey them if they want to do business there.

PH is pushing the limits all the time, fuck them. We need responsible companies, not shitbags like this.

But yeah... having porn performers behind them makes it a strong case for sure

Meanwhile, lawyers don't lack such creativity, as seen in all the latest "me 2" movements where people are being sued left and right for "rape" that happened 20-30 years a go and there's no real evidence. Where people get to "pick" their gender and that's normal so its just a matter of time cp will be legalized as 40 year old pedo will say he is 6 year old girl (already happening in some countries). Where pornstars can overturn contracts. Where males compete with women in sports because they are "female".

Yes, in these cases, discrimination against a porn company and performers presented in correct way will fail.
Just needs money and right lawyers.

BTW:

Every single country in EU can legally ban porn, there is not such thing like pornography protected by freedom of speech here. There are rulings of The European Court of Human Rights which clearly state that every country can set their own boundaries when protecting morals. And you believe they would win this with creativity?

Pornhub promoted pornography on a social network which can not only make their own rules but they are also obliged by law to protect children and morality. Comparing a profile of a porn company to a pic of the fat Kardashian's ass that was created for a completely different purpose just shows they don't get the point at all - and their "creative" lawyers too...

You are so clueless...
