There is something to be said about the likes of Duke Dollars (very prolific) and Max Hardcore (retired).

On one hand, you will have some girls who are into it (albeit, very rarely).

On the other hand, what they're doing can be construed as taking advantage, and makes them liable for a class action suit, much like with Girls Do Porn (although to a lesser extent, but still, you could do it -- and probably win, with a good litigator).

Even though you could say that Amazon (and everyone else) is taking advantage of their workforce, you can't say that they are taking their dignity, however.

Porn is just porn (or, it should be): The John's get off, and the girl and the producers get paid. Everyone is happy. Generally, and to a point.

Since there are no royalties in porn, the producers get lifetime exploitation rights (unless they sold their content to third parties). But the performers have no actual rights, and the rights owners get very mad if they're told that they can't expect lifetime exploitation rights to a scene from a moral point of view. Yet, we will have a lot of cases going forward where you're going to see scenes being taken down without any litigation, even.

Because, if you don't, you could pretty much lose everything should it go to court.

You paid for it, fair and square. But, can you expect lifetime exploitation rights, considering you paid a very meager one-time sum? I don't know, morally? It can be deemed reprehensible, but legally -- it's yours.

But this is where it gets even trickier: This is not "porn". This is something that can ruin someone's life, or cater to someone's very dark and twisted fantasies. Which, again; are fantasies -- but when cultivated, they can become something more.

There is no twisting this: such content can in fact make certain people (nutters, abusers, etc) wish for the "real" thing even more. That is; to degrade someone and make them yours. Completely.

You could say that the same thing could be said about Kink, but here's the thing. The degradation factor is nowhere close enough as with Facial Abuse, Max Hardcore, and sometime ago -- Meatholes.

Some people might not like their content. But it not only sells, it also can't be considered your average porn, because it's something more. It degrades someone to a point where you either like it being done to you, or... you had to do it, because you really, really needed the dough. One makes a good case for the director and the producer, but the other one... Well, to most people, it makes them believe the narrative that the very religious people push when it comes to porn.

IIRC, you shoot from when they enter the premises, up until the point they leave.

Legally, you're more than covered.

No one can claim that you barricaded someone into a room, gave them alcohol, or intimidated them -- physically.

But let's say... a model wants to have her scene removed. She sends vague threats. You tell her to buzz off and forget about her. She gets in contact with a few other models, and they find an attorney. They then decide that the x,xxx they got paid for the scene wasn't worth it for lifetime exploitation rights, and that they can't find employment due to the scene(s) that they shot for you.

If they shot a scene for Playboy, then they likely wouldn't be able to make as good of a case as if they shot a scene for Facial Abuse.

So I think it matters. A lot. Especially if they can prove their state of the mind, their living situation, financials, etc. A good litigator could argue that they wouldn't have made the choice in a different situation, and that you took advantage of them.

That's why I think that letting it go to trial is a very bad idea for the porn industry as a whole, and that the class action suits like the one that brought Girls Do Porn, and crippled MindGeek are the future, and the paysite operators should be very, very careful.

They will most likely need to implement straightforward policies when it comes to removal of scenes (whether to purchase them back for a nominal fee, or to take them down completely, and assist in removal from the Internet) and do both pre and post interviews talking about their mental state, and if anything is even remotely off, then they shouldn't shoot a scene like that. They have to be made aware of the viral aspect of such content, and the fact that they may regret it sooner rather than later

Honesty is the best policy, and we absolutely agree there.
