New Mandatory Condoms in Porn - New Law (California)

Just saw this on MSNBC.

Not yet passed but could be on Thursday...

http://www.msnbc.msn.com/id/35782713

If this passes I think it will drive most shooting to Vegas or elsewhere.

So are they trying to protect the general public, or porn stars?

What's safer? Fucking by people who have had AIDS tests, or random drunk hookups in any random city in the US? The logic is baffling.

If it passes I hope it includes a grandfather clause to ensure all previous productions are ok. Lets talk from a political standpoint, maybe the gov't wants to pass on the responsibility of exhibiting safe sex to people to control diseases etc. In theory we should agree as its a good idea, however in mainstream movies drugs, alcohol and booze are prominent so why do we need to take a hit in this regard. If they pass such a rule its yet another hit to your freedom of speach. Not cool.

It won't pass, but if it did, I'd expect a mass exodus of shooters out of California and scenes being bought or shot elsewhere.

It's a very slippery slope from regulating on-camera sex in the name of occupational safety to regulating off-camera sex in the name of public health safety.

Too much $$ flows through porn valley. CA can't afford to lose any of it right now. Based on that I think it will not pass.

Doesn't help my mind from racing about where the lines would be drawn.

This has been tried before and it has failed. For years I have lobbyed with the FSC in Sacramento and can tell you that in past years the legislature has been very open and friendly to the industry and as often received support from certain members.

However the two issues that most concerned legislators and staff members were health care for the industry and treating the performers better. They understand that if drive the industry out of California the state will suffer.

But there is a breaking point. Are we there yet... no one knows.

Here's the problem though, its not legal to film in any other state besides New Hampshire and the industry wont move there. And Florida is not adult friendly as we have seen in several cases now. Nevada might be an option but even the brothels have stringent restrictions on them and some might soon be fading into the desert as the counties they are in continue to grow.

Catholics dont believe in using condoms, so how could a condom be forced to be used on a catholic girl? I understand she's shooting porn, but maybe contraceptives are something she's not willing to budge on.. just shooting something out there in light of god vs state.. but I really doubt this will pass anyways..

yeah and free speech too..

as Michael mention, shooting porn is not considered legal in states other than CA and NH.
Vegas would be where the industry would go, some perhaps even to Phoenix where there is already a decent amount of shooting going on.
But both those locations are not legal, shooting porn would by the eyes of the law considered as a form of prostitution..

This is exactly whatIi was thinking. They're already bailing out a battle ship with a dixie cup, they can't afford to lose more legit businesses.

OK here's the deal and this is no joke !
Purely by coincidence i am moving to New Hampshire this summer ( the only other state in the USA where its legal to shoot porn)
I was going to retire and sell off my porn content / program etc and concentrate on my ceramic business.
But if this shit happens and condoms are made mandatory i would be happy to shoot for a very select number of programs
Just throwing it out there in case anyones interested ?

I honestly don't think so. Had the same question but doubt we'll get an answer from one of the lawmakers.

so it was voted to "further study a proposal that would require porn actors to wear condoms during sex scenes."
so for now nothing has changed..

Well it passed...meaning there will be an advisory committee made of industry peeps and experts in employee safety.

It will probably take 2 yrs for any real change to come about -- if there really is a change to enforce condoms on set in California.

I highly doubt it though. This measure has little to no support from the legislature in California since everyone knows we cannot afford to lose a single tax dollar.

I see other things coming from this though -- work comp insurance for all production companies in California. That actually puts money into the state coffers....
