He's fucked, if he had a top flight attorney who could destroy these witnesses credibility maybe he'd have a chance but I still think any jury is going to convict him, a 40 year old man way too involved in the lives of young teenage girls = where there's smoke there's fire. Seems to like this was a track record... There was a few cases in the past where he was accused and even arrested, but it seemed like the charges were dropped. When the new charges came up someone looked at his prior record and most likely said "where there is smoke there is fire, and there seems to be a lot of smoke".

Not as evidence since it is purely circumstantial. It might be brought in but even a crappy attorney would object to it being circumstantial and not relevant. Also, considering that he participated in the legit, age verified, adult industry it could play against the prosecution since it demonstrates that he was concerned about legal age limits.

I of course am not an attorney but I do know enough to offer at least a semi educated opinion.

Donny Pauling dismissed his defense attorney less than two weeks before he is scheduled to go on trial on sex charges.

Roberto Marquez filed a motion in Sutter County Superior Court on Thursday requesting he be relieved as attorney of record for Pauling. The motion is scheduled to be heard today.

The jury trial is scheduled to begin Sept. 29.
In a declaration, Marquez said he met with Pauling, accused of having unlawful sex with three minor girls, in jail earlier this week.

Pauling "informed me that he no longer desired my services and that he was discharging me from representing him in his cases in the Sutter Superior Court," Marquez said in the court filing.

Marquez wrote, "There has been an irreparable breakdown in the attorney-client relationship, making it impossible to render effective assistance to Mr. Pauling," the declaration said.

Marquez said he could not comment.

In the motion, Marquez said the attorney may be changed at any time, upon the application of either client or attorney.

I think Donny is in the fight of his life right now. This goes one of two ways - He either gets off and tries to pick up the pieces of his life, or he goes to prison and eventually registers as a sex offender for the rest of his life.

I think firing his attorney shortly before his trial is the worst possible thing he can do.

I am guessing this is a court appointed attorney. I can imagine a court appointed attorney is not going to be the best "money could buy". But I don't think he'll get a better attorney, and surely this cannot hurt his case.

I'm sure that's the angle, but it's pretty obvious that's what he's doing so he'll only get to do it once. He's not buying himself much time, but I guess at this point...something is better than nothing.

Te most likely scenario is that when it gets closer to trial his attorney is telling him how fucked he is, to take the deal, telling him he's going to do time and because he's not hearing what he wants to hear, he fires the messenger. He can only think in terms of what he wants, not what is. Pretty typical of a sociopath. As he rots after a conviction, his story will always be that his attorney fucked him, everyone lied, nothing was fair etc.

Another article showed up this morning.....

Donny Pauling began representing himself in court Friday.

Pauling has pleaded not guilty to 19 criminal charges involving unlawful sex acts with three teen girls. If convicted, he faces up to 20 years in prison.

Sutter County Superior Court Judge Susan E. Green relieved Roberto Marquez as Pauling's defense attorney and appointed Pauling to represent himself in response to a motion filed by Marquez on Thursday.

She did so after she expressed concerns about Pauling's decision to dismiss Marquez, given the seriousness of the charges and the proximity to the Sept. 29 jury trial.

A former Chico-based pornography producer, Pauling, 41, had said he found God and traveled to churches around the country as an anti-pornography activist. He lived in Yuba City when he was arrested Dec. 1 on suspicion of on-going sexual acts with a teen girl. Investigation led to two additional alleged victims and charges, including an act of unlawful sex with a girl while former Sutter County sheriff's Lt. Lewis McElfresh allegedly watched while masturbating.

Marquez, who has represented Pauling since January, will hand over his trial preparation binders to Pauling. And Investigators in the case can now talk to Pauling directly, Green said.

"I've wanted that from the beginning," Pauling said. "I believe if I tell the truth, the truth will come out."
In his first action on his own behalf, Pauling made a motion to continue the trial. Deputy District Attorney Anu Chopra objected. Green told Pauling he has to file a written motion to be heard on the matter.

Pauling also requested to be appointed co-counsel.

He is scheduled to return to court Sept. 24 to argue motions about what trial evidence.

Pauling has an Associate's Degree from DeVry University in computer science. If not for his arrest, he said, he would also have degrees in philosophy and psychology.

"I have some concerns that your defendant is not making a good decision in firing you," Green said to Marquez before she granted the motion.

"At this point, I think things are broken down enough that there needs to be a change," Pauling told Green.
"It's an irreconcilable breakdown," Marquez said.

Pauling said he didn't learn there was a Friday court date until he read a newspaper story. He had requested a hearing to be scheduled Monday because "I said I might fire you," Pauling said.

During the hearing, Green closed the courtroom to allow for a candid conversation with Pauling and Marquez. She had told Pauling to stop talking in public court because, she was concerned about him presenting confidential information that may harm him.

By taking over the role as his own representative, Pauling gave up his right to appeal any conviction on the basis of poor representation. Green told him he will get no special treatment, and she expects him to make appropriate objections.

If he misbehaves, he will lose his right to represent himself; If he misbehaves in jail, he could lose time in the law library, Green said.

I won't be shocked to later hear that his lawyer was encouraging him to take a deal that may have been offered him or pursue a deal and he refused then decided that this lawyer didn't have his best interesting in mind.

That and he might be trying to delay things as other people suggested. I won't be shocked if the court doesn't allow him another delay.

That's always the case - they blame it all on everyone else.

Here is what I don't understand. He had a girl (or girls) living with him that he was not related to. He was arrested on suspicion of molesting these girls before in the past. Let's just assume he was innocent... Wouldn't he want to put as much distance between him and these girls or any other girls just so it never even came up again?

To make a very long story much shorter Donny was a guy who worked in the porn biz. He left the biz when he said he found God and started making money giving speeches and making appearances as an anti-porn advocate. He was a fairly controversial guy when he was in the biz and continued to sometimes show up on GFY after he left it.

He was arrested for a few things. One of the charges (forgive me I am no lawyer so I'm not sure what the proper charges are I'm just describing what I know) is that he was having sex with a 12-13 year old girl who was living with him. Another charges was a friend of his who was prison corrections officers supposedly asked Donny to have sex with his daughter who was in that same age range while he watched and jerked off. The claim is that Donny did just that.

There are likely other lesser charges added on in relation to these things, but this is the jist of what he is in trouble for. Upon his arrest he was hit with (I think) a million dollar bail. He didn't have the money to make bond so he has been sitting in jail for several months while waiting to go to trail. At last his trial is happening in a just a few weeks and now he has fired his lawyer and appears to be representing himself.

Even licensed attorneys do not handle real criminal trials unless they've had experience alongside a lead attorney during law school (internships) and for a year or two after law school. So this Donny character just made it much much worse for himself.

I've done a bit of research regarding this topic, and my conclusion is that the law and conviction is based not on the age, but on the physical development of the minor. For instance, if the law seeks to convict you of pedophilia, they would not be required to prove to a jury that you were fucking a woman that appeared to be 35 but you neglected to check her ID, but that she had narrow hips, and under-developed breasts, and legitimately appeared to be underage. The distinction being an attraction to children, not physically developed minors.

Of course, you will still be convicted if you have sex with a 17 year and 364 day old, but the argument will not be that you were a pedophile.

Also... judges & juries tend to convict people based not on actions, but on intentions.

Te most likely scenario is that when it gets closer to trial his attorney is telling him how fucked he is, to take the deal, telling him he's going to do time and because he's not hearing what he wants to hear, he fires the messenger. He can only think in terms of what he wants, not what is. Pretty typical of a sociopath. As he rots after a conviction, his story will always be that his attorney fucked him, everyone lied, nothing was fair etc.

Pauling has pleaded not guilty to 19 criminal charges involving unlawful sex acts with three teen girls. If convicted, he faces up to 20 years in prison. Sutter County Superior Court Judge Susan E. Green relieved Roberto Marquez as Pauling's defense attorney and appointed Pauling to represent himself in response to a motion filed by Marquez on Thursday. She did so after she expressed concerns about Pauling's decision to dismiss Marquez, given the seriousness of the charges and the proximity to the Sept. 29 jury trial. A former Chico-based pornography producer, Pauling, 41, had said he found God and traveled to churches around the country as an anti-pornography activist. He lived in Yuba City when he was arrested Dec. 1 on suspicion of on-going sexual acts with a teen girl. Investigation led to two additional alleged victims and charges, including an act of unlawful sex with a girl while former Sutter County sheriff's Lt. Lewis McElfresh allegedly watched while masturbating. Marquez, who has represented Pauling since January, will hand over his trial preparation binders to Pauling. And Investigators in the case can now talk to Pauling directly, Green said. "I've wanted that from the beginning," Pauling said. "I believe if I tell the truth, the truth will come out." In his first action on his own behalf, Pauling made a motion to continue the trial. Deputy District Attorney Anu Chopra objected. Green told Pauling he has to file a written motion to be heard on the matter. Pauling also requested to be appointed co-counsel. He is scheduled to return to court Sept. 24 to argue motions about what trial evidence. Pauling has an Associate's Degree from DeVry University in computer science. If not for his arrest, he said, he would also have degrees in philosophy and psychology. "I have some concerns that your defendant is not making a good decision in firing you," Green said to Marquez before she granted the motion. "At this point, I think things are broken down enough that there needs to be a change," Pauling told Green. "It's an irreconcilable breakdown," Marquez said. Pauling said he didn't learn there was a Friday court date until he read a newspaper story. He had requested a hearing to be scheduled Monday because "I said I might fire you," Pauling said. During the hearing, Green closed the courtroom to allow for a candid conversation with Pauling and Marquez. She had told Pauling to stop talking in public court because, she was concerned about him presenting confidential information that may harm him. By taking over the role as his own representative, Pauling gave up his right to appeal any conviction on the basis of poor representation. Green told him he will get no special treatment, and she expects him to make appropriate objections. That and he might be trying to delay things as other people suggested. I won't be shocked if the court doesn't allow him another delay.
