Depends if the contract was for a completed price or for time and material + a negotiated profit. Where the worker's wages paid or not.
If the subcontractor agrees to a completion date then he is on the hook for the worker's wages -- not the builder. The law only requires that you pursue the work in a workman like manner with diligence. Having insufficient personnel on hand can be a breach of contract obligation. That said, I once leined 200 lots in a subdivision as I did improvements to the entire site and wasn't paid as agreed. When I found out that the road paver had not been paid in months I immediately slapped a lien on the whole development and this stopped their construction loan take outs with the bank -- I cut off their water. They paid me in a few days ... Some builders never defaulted and some I extended terms when they needed it -- that's just how the building business works. |
